Chapter 166 — Offenses Against Public Order; Firearms and Other Weapons; Racketeering
ORS 166.265 Manufacture, importation, sale or transfer of undetectable firearm
A person may not knowingly manufacture or cause to be manufactured within this state, import into this state, or offer for sale, sell or transfer, an undetectable firearm.
A violation of paragraph (a) of this subsection is a Class B felony.
A person may not knowingly possess an undetectable firearm.
A violation of paragraph (a) of this subsection is a Class A misdemeanor.
Notwithstanding subparagraph (A) of this paragraph, a violation of paragraph (a) of this subsection is a Class B felony if, at the time of the offense, the person has one or more prior convictions under this section or ORS 166.266 or 166.267.
A person convicted under this section shall forfeit the undetectable firearm.
As used in this section, “prior conviction” includes a conviction for a violation offense.
