ORS 37.080 Required disclosures relating to conflicts of interest
A court may not appoint a person as a receiver unless the person first:
Discloses whether the person:
Is an affiliate of a party to the receivership;
Has an interest materially adverse to an interest of a party to the receivership;
Has a material financial interest in the outcome of the action, other than compensation approved by the court;
Has a debtor-creditor relationship with the owner; or
Holds an equity interest in a party to the receivership, other than a noncontrolling interest in a publicly traded company; and
Affirms under oath that the person’s disclosure under subsection (1) of this section is true and complete.
