ORS 419C.492 Court’s authority to review placement
Commitment of an adjudicated youth to the Oregon Youth Authority or the Department of Human Services does not terminate the court’s continuing jurisdiction to protect the rights of the adjudicated youth or the adjudicated youth’s parents or guardians. Notwithstanding ORS 419C.478 (5), if upon review of a placement of an adjudicated youth made by the youth authority or the department, the court determines that the placement is so inappropriate as to violate the rights of the adjudicated youth or the adjudicated youth’s parents or guardians, the court may direct the youth authority or the department to place the adjudicated youth in a specific type of residential placement, but the actual planning and placement of the adjudicated youth shall be the responsibility of the youth authority or the department. Nothing in this section affects any contractual right of a private agency to refuse or terminate a placement.
