Chapter 435 — Reproductive Health Care and Rights
ORS 435.215 Right to accept or refuse services protected
An individual’s acceptance or refusal to accept reproductive health care information and services may not:
Be grounds for the loss of any privilege or immunity to which the individual is otherwise entitled; or
Affect the individual’s right to receive public assistance, medical assistance, as defined in ORS 414.025, or any other public benefit.
An officer, employee or agent of a public body who is engaged in the provision of reproductive health care information and services:
Shall advise every individual to whom the officer, employee or agent of a public body provides reproductive health care information and services, both orally and in writing, of the rights described under subsection (1) of this section;
Shall recognize that the right to make decisions concerning reproductive health care is a fundamental personal right of the individual and that nothing in ORS 435.190 to 435.245, 435.475 or 435.485 or ORS chapter 436 in any way abridges that right; and
May not require any individual to state the reason for accepting or refusing the offer of reproductive health care information and services.
