Chapter 448 — Pool Facilities; Water and Sewage Systems
ORS 448.450 Powers and duties of Oregon Health Authority; rules; fees
The Oregon Health Authority shall:
Adopt rules necessary to carry out the provisions of ORS 448.450 to 448.465, 448.992 and 448.994.
Classify all potable water treatment plants and water distribution systems actually used or intended for use by the public. In classifying the potable water treatment plants and water distribution systems, the authority shall take into consideration size and type, character of water to be treated and other physical conditions affecting the treatment plants and distribution systems and the skill, knowledge and experience required of an operator.
Certify persons qualified to supervise the operation of a potable water treatment plant or a water distribution system.
Subject to the prior approval of the Oregon Department of Administrative Services, establish a schedule of fees for certification under paragraph (c) of this subsection. The fees established under the schedule shall be sufficient to pay the cost of the authority in carrying out the provisions of ORS 448.450 to 448.465, 448.992 and 448.994 and shall be within the budget authorized by the Legislative Assembly as that budget may be modified by the Emergency Board.
Notwithstanding the authority of the Oregon Health Authority to establish fees for certification under subsection (1)(d) of this section, the authority will not establish fees for certification of operators of water systems serving ground water to fewer than 150 service connections.
In adopting rules under this section, the authority shall consult with the Department of Environmental Quality in order to coordinate rules adopted under this section with rules adopted by the Environmental Quality Commission under ORS 448.410.
