Chapter 624 — Food Service Facilities
ORS 624.145 Authorization of food place required for third-party food platform to take orders and deliver meals
As used in this section:
“Food place” means a restaurant as defined in ORS 624.010, or another business engaged in the preparation and service of food for consumption by the general public on or off premises.
“Third-party food platform” means a website, mobile application or other electronic service that:
Posts food place menus, logos or pricing information on the website, mobile application or other electronic service;
Facilitates the ordering of food or beverages for sale to a consumer by a food place; and
Delivers, or arranges for the delivery of, the order to the consumer; or
Arranges for the pickup of the order by the consumer from the food place.
A third-party food platform may not take and arrange for the delivery of an order from a food place without first obtaining the written consent of the food place expressly authorizing the third-party food platform to take orders and deliver meals prepared by the food place.
