Chapter 431A — Public Health Programs and Activities
ORS 431A.178 Civil penalty for violation of ORS 431A.175, other law, rule or regulation governing tobacco products or inhalant delivery systems
The Oregon Health Authority may impose a civil penalty against a person that engages in the wholesale or retail sale of tobacco products or inhalant delivery systems, as those terms are defined in ORS 431A.175, if the person violates:
A state law or rule or federal law or regulation that governs the wholesale or retail sale of tobacco products or inhalant delivery systems for purposes related to public health and safety.
A civil penalty imposed under this section may not be more than $5,000 per violation.
Amounts collected under this section shall be deposited in the General Fund.
