Chapter 469 — Energy; Conservation Programs; Energy Facilities
ORS 469.289 Contracting to administer incentive payments for early compliance
As used in this section, “person” means an individual, corporation, nonprofit corporation, professional corporation, limited liability company, partnership, limited partnership, limited liability partnership, cooperative, business trust, joint venture or other form of business entity, including Energy Trust of Oregon.
The State Department of Energy may contract with another person to administer incentive payments to eligible building owners for early compliance with the energy performance standard described in ORS 469.277.
The person with which the department contracts under subsection (2) of this section shall administer incentive payments:
To eligible building owners that the department certifies as qualifying for incentive payments under, and at rates established for the payments in, ORS 469.291.
A person that administers incentive payments on the department’s behalf:
Remains subject to any obligations the person has or will have to provide energy efficiency programs or incentives to the person’s customers; and
Is not liable for excess incentive payments the person makes in reliance on the department’s certification or determination of the proper amount of the incentive payment, if the person is not otherwise responsible for any inaccuracy in the amount of the incentive payment.
