Chapter 97 — Rights and Duties Relating to Cemeteries, Human Bodies and Anatomical Gifts

ORS 97.981 Purchase or sale of body parts prohibited

(1)

Except as otherwise provided in subsection (3) of this section, a person commits the crime of purchase or sale of a body part for transplantation or therapy if the person, for valuable consideration, knowingly purchases or sells a body part for transplantation or therapy if removal of the body part from an individual is intended to occur after the individual’s death.

(2)

Purchase or sale of a body part for transplantation or therapy is a Class C felony.

(3)

A person may charge a reasonable amount for the removal, processing, preservation, quality control, storage, transportation, implantation or disposal of a body part.
