Chapter 274 — Submersible and Submerged Lands
ORS 274.760 Considerations involved in granting lease or easement
After the public hearing the Department of State Lands shall determine whether the granting of an easement or an invitation for bidding to lease the area under consideration would be in the public interest. In such determination the department shall consider whether an easement or a lease or leases of the area under consideration would:
Be detrimental to the health, safety, or welfare of persons residing in, owning real property, or working in the neighborhood of such areas;
Interfere with the residential or recreation areas to an extent that would render such areas unfit for recreational or residential uses or unfit for park purposes;
Destroy, impair or interfere with the aesthetic and scenic values of the Oregon coast, or other affected area;
Create any air, water or other pollution;
Substantially endanger marine life or wildlife;
Substantially interfere with commerce or navigation; and
Protect state lands from drainage of oil and gas.
