Chapter 443 — Residential Care; Adult Foster Homes; Hospice Programs
ORS 443.825 Disposition of penalties recovered
All penalties recovered under ORS 443.790 to 443.815 shall be deposited:
In the Quality Care Fund established in ORS 443.001 if paid by an adult foster home licensed to provide residential care to persons with physical disabilities.
In the Long Term Care Ombudsman Account established in ORS 441.419 if paid by an adult foster home licensed to provide care to persons with mental illness or developmental disabilities. [1987 c.431 §9; 2009 c.837 §35; 2013 c.717 §16]
(Temporary provisions relating to adult foster homes and other community-based care settings)
Note: Sections 4 and 7, chapter 617, Oregon Laws 2025, provide:
Sec. 4. (1) As used in this section, “adult foster home” has the meaning given that term in ORS 443.705.
The Department of Human Services and the Housing and Community Services Department shall study:
Opportunities to offset the cost of creating new adult foster homes and other community-based care settings; and
The impact on adult foster homes and other community-based care settings of building code requirements, including the installation of automatic sprinkler systems.
The departments shall submit a report in the manner provided by ORS 192.245, and may include recommendations for legislation, to the interim committees of the Legislative Assembly related to health and human services no later than August 15, 2026. [2025 c.617 §4]
Sec. 7. Sections 2 to 5 of this 2025 Act are repealed on January 2, 2027.
