Chapter 506 — Application, Administration and Enforcement of Commercial Fishing Laws
ORS 506.201 Powers of commission in regard to real property
The State Fish and Wildlife Commission may:
Acquire by purchase, lease, gift, agreement or donation, real property, or any right or interest therein, including any easement or right of access, necessary:
To construct or maintain fish hatcheries, fishways or research facilities;
To remove logjams; or
Otherwise to carry out the duties imposed on the commission by law.
Acquire by exercise of the power of eminent domain any easement or right of access necessary to construct or maintain fishways or remove logjams. Proceedings instituted by the commission under this subsection shall be conducted in accordance with ORS chapter 35.
Lease, dispose of or grant easements upon any property owned by the state and used for the protection, propagation or preservation of food fish, which is found to be of no further use or value to the state. The commission shall turn over the proceeds arising from such disposition to the State Treasurer to be credited to the General Fund.
