Chapter 475A — Psilocybin Regulation
ORS 475A.586 Certain information related to licensure exempt from disclosure
Subject to subsection (2) of this section, information is exempt from public disclosure under ORS 192.311 to 192.478 if the information is:
Personally identifiable information, as defined in ORS 432.005;
The address of a premises for which a license has been issued or for which an applicant has proposed licensure under ORS 475A.290, 475A.305 or 475A.594;
Related to the security plan or the operational plan for a premises for which a license has been issued or for which an applicant has proposed licensure under ORS 475A.290, 475A.305 or 475A.594; or
Related to any record that the Oregon Health Authority determines contains proprietary information of a licensee.
The exemption from public disclosure as provided by this section does not apply to:
The name of an individual listed on an application, if the individual is a direct owner of the business operating or to be operated under the license; or
A request for information if the request is made by a law enforcement agency, unless the information requested is confidential pursuant to ORS 475A.587.
For purposes of subsection (2)(a) of this section, an individual is not a direct owner of the business operating or to be operated under the license if:
The direct owner of the business operating or to be operated under the license is a legal entity; and
The individual is merely a general partner, limited partner, member, shareholder, or other direct or indirect owner of the legal entity.
Note: The leadline to ORS 475A.586 originally enacted by the people was deleted by legislative action.
